These terms apply to the Barva app and this website, provided by João Filipe Narciso Figueira Mira, Rigaer Str. 22A, 10247 Berlin, Germany (hello@joaomira.com). By using Barva you agree to them.
1. What Barva is
Barva helps you log workouts, time your rest, browse exercises and follow a training plan. Barva is a tool for planning and recording training. It isn't medical advice and doesn't replace a doctor, physiotherapist or qualified trainer.
2. Train safely
Exercise carries a risk of injury. Before starting a new training program, especially if you have a health condition, an injury or haven't trained in a while, check with a doctor. Learn correct technique, start with light weights, and stop if you feel pain, dizziness or shortness of breath. You train at your own risk.
3. Your account
You can use Barva as a guest or with a sign in. Keep access to your sign in method safe. You can delete your account at any time in the app under Settings > Account.
4. Acceptable use
Don't misuse Barva: don't try to access other people's data, disrupt the service, reverse engineer the app beyond what the law allows, or use it to break the law.
5. Content
The app, its design and its texts belong to Barva or its licensors. Exercise descriptions and images come partly from third party sources and are provided for guidance only. Your workout data belongs to you.
6. Availability and changes
Barva is provided as it is and may change, gain or lose features over time. We aim to keep it running smoothly but can't promise it will always be available or free of errors.
7. Liability
Barva is liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence, Barva is only liable for breaches of essential obligations, limited to the damage that is typical and foreseeable. Liability under the German Product Liability Act is unaffected.
8. Paid features
Barva is currently free. If paid features are introduced, their terms and prices will be shown in the app before you buy, and purchases will be handled by Apple or Google under their terms.
9. Changes to these terms
These terms may be updated. The date at the top shows the latest version. If a change affects you significantly, it will be announced in the app.
10. Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you're a consumer in the EU, the mandatory consumer protection rules of the country you live in still apply. The European Commission's online dispute resolution platform is at ec.europa.eu/consumers/odr; we're not obliged or willing to take part in consumer arbitration proceedings.
